STANDARD WILL vs. POUR-OVER WILL
When a person creates a trust, he or she normally prepares a pour-over
will with it. A Pour-over will simply instructs that once
the assets outside of trust are collected, they are to be returned to
the trust for distribution there. Both wills are fairly
simple, but a pour-over will leaves the residue all to the trust.
WHAT IS A TESTAMENTARY TRUST?
A Testamentary Trust is a Trust which is created in a will, and which is under court jurisdiction.
CAN ASSETS OUTSIDE OF THE TRUST BE PUT IN THE TRUST AFTER DEATH?
Generally, a pourover will or a
Hegstad petition is used to put assets which are left out of the trust,
back in the trust.
